Federal Court Mandates Freedom of Abrego Garcia from Immigration Custody
A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without legal authority.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.
The situation stems from a erroneous deportation to El Salvador in March, which the government later acknowledged was an error. Following his repatriation to the United States to face alien smuggling charges, he was held in immigration custody.
In her order, the court pointed out that the authorities lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
Background of the Case
The legal challenge involve conflicting claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this claim.
He has also pleaded not guilty to the conspiracy charges, which are part of a ongoing criminal case in Tennessee.

The court, who was overseeing his petition to removal in a Maryland district court, ruled that he must now adhere to the conditions of his release from jail in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
